These Terms and Conditions of Sale govern all online purchases, quote requests, pickup orders, delivery orders, shipped orders, warranty submissions, and return requests with Mekco Supply Inc. By placing an order, requesting a quote, picking up products, or accepting delivery, you agree to these terms. Nothing here reduces any rights that cannot legally be limited under applicable consumer protection, privacy, sale of goods, or other laws.
Pricing, Quotes & Taxes
Currency
All prices are listed in Canadian dollars unless stated otherwise. Prices do not include applicable taxes, shipping, delivery, handling, duties, customs charges, installation costs, permit costs, or other additional charges unless expressly stated.
Taxes
Applicable taxes will be charged based on the order, delivery location, pickup location, product type, and legal requirements.
Price Changes
Prices are subject to change without notice. A price displayed on the website or provided in a quote is not guaranteed after the quote expires or after the price is corrected due to an error.
Quote Validity
Written quotes are valid only for the period stated in the quote. If no validity period is stated, the quote is valid for seven (7) calendar days, unless withdrawn earlier due to supplier price changes, stock shortages, obvious errors, or other circumstances beyond our reasonable control.
Bulk & Project Pricing
Bulk, wholesale, commercial, project, or special-order pricing may be subject to minimum quantities, deposit requirements, credit approval, freight charges, manufacturer lead times, and special conditions.
Payment Terms
Payment at Checkout
Payment is due at checkout unless Mekco Supply has approved other payment terms in writing.
Payment Methods
We may accept payment methods such as Visa, Mastercard, American Express, Interac e-Transfer, and other approved methods. Online card payments may be processed through third-party payment processors. We do not intend to store full credit card numbers on our own servers.
Credit Accounts
Commercial and wholesale accounts may be eligible for credit terms, such as net-30 payment terms, only after approval by Mekco Supply. Credit terms may be changed, suspended, or revoked if payments are late, credit risk changes, or account requirements are not met.
Overdue Amounts
Overdue amounts may be subject to service charges or interest at the rate stated on the invoice, credit agreement, or the maximum rate permitted by law. Customers are responsible for reasonable collection costs, including legal fees, where permitted by law.
Chargebacks
You agree not to initiate an improper chargeback for a valid transaction. If there is a billing concern, damaged item, missing item, return request, or dispute, please contact us promptly so we can review and resolve the matter.
Order Placement, Changes & Cancellations
Offer & Acceptance
When you place an order, you are making an offer to purchase the selected products under these Terms. An automatic order confirmation confirms that we received your order, but it does not guarantee acceptance, availability, pricing, or shipment. An order is accepted only when Mekco Supply confirms acceptance, issues an invoice, prepares the order for pickup, ships the order, delivers the order, or otherwise confirms fulfillment.
Refusing or Holding Orders
We may refuse, cancel, limit, or hold an order for reasonable reasons, including product unavailability, pricing or website errors, suspected fraud, credit approval issues, incomplete information, shipping restrictions, supplier limitations, unpaid balances, or compliance, safety, or legal concerns.
Customer Cancellation
You may request to change or cancel an order by contacting us as soon as possible. We will make reasonable efforts to assist, but changes or cancellations are not guaranteed once an order has been picked, packed, shipped, delivered, released for pickup, submitted to a supplier, custom-cut, or otherwise processed.
Special-Order Items
Special-order, custom, non-stock, made-to-order, custom-cut, clearance, final-sale, or supplier-direct items may be non-cancellable and non-returnable once the order is placed or submitted to the supplier.
Backorders
If an item is backordered, delayed, discontinued, or unavailable, we may contact you with available options, such as waiting for stock, substituting an approved alternative, partially shipping available items, or cancelling the affected item.
Store Pickup
Pickup Hours
Free pickup is available at our Richmond Hill location during business hours (Mon-Fri 7am-5pm · Sat 8am-11am EST).
Identification
You may be required to provide order confirmation, government-issued identification, business identification, proof of authorization, or the payment card used for the order. If someone else will pick up your order, you should notify us in advance.
Inspection at Pickup
Products are deemed received when they are picked up by you or by a person authorized to pick them up on your behalf. You should inspect the order at pickup and notify us promptly of any visible damage, shortage, or error.
Uncollected Orders
Orders not picked up within a reasonable time may be subject to storage, cancellation, restocking, or return-to-stock procedures. We may contact you before taking such action where practical.
Shipping & Delivery
Delivery Options
Mekco Supply may offer local delivery, Greater Toronto Area delivery, Canada-wide shipping, carrier shipping, freight shipping, jobsite delivery, or other delivery options depending on product type, size, destination, availability, and order value.
Estimated Dates
Shipping and delivery dates are estimates only. We are not responsible for delays caused by carriers, weather, traffic, labour disruptions, supplier delays, customs processes, shortages, incorrect addresses, failed delivery attempts, inaccessible jobsites, or other circumstances beyond our reasonable control.
Accurate Delivery Information
You are responsible for providing complete and accurate delivery information. If delivery fails or is delayed because of incorrect, incomplete, unsafe, inaccessible, or misleading information, you may be responsible for additional shipping, storage, redelivery, return, or handling costs.
Risk of Loss
For commercial orders, jobsite deliveries, and orders shipped by common carrier, risk of loss generally transfers when the products are delivered to the carrier, jobsite, pickup point, or delivery address, unless otherwise required by law or agreed in writing. For consumer purchases, risk transfers as required by applicable consumer protection and sale of goods laws.
Unattended Delivery
Delivery to the address, loading area, receiving area, jobsite, curbside, warehouse, mailroom, or other location specified by the customer may constitute delivery, even if the customer or their representative is not present, where unattended delivery was requested, authorized, customary, or reasonably necessary.
Freight & Special Handling
Large, heavy, fragile, oversized, hazardous, or freight items may require special handling, equipment, unloading assistance, appointments, liftgate service, dock access, or additional charges.
Inspection, Damage & Delivery Claims
Inspect Promptly
Please inspect all products promptly upon pickup or delivery and before installation, resale, alteration, or use.
48-Hour Reporting
For visible shipping damage, missing cartons, incorrect products, or quantity shortages, you should notify Mekco Supply as soon as possible and preferably within forty-eight (48) hours of delivery or pickup. For concealed damage that could not reasonably be discovered immediately, notify us as soon as it is discovered.
What to Provide
When reporting damage, shortages, or errors, please provide: order or invoice number; photos of the product, packaging, shipping label, and damage; a description of the issue; delivery date and carrier information; and any bill of lading, delivery receipt, or proof of delivery details.
Freight Damage
If products arrive visibly damaged by freight or carrier shipment, note the damage on the delivery receipt or bill of lading before signing, where possible. If damage is severe, you may refuse the damaged portion of the shipment and contact us promptly.
Preserve Evidence
Do not discard damaged products, packaging, labels, or documents until the claim is resolved. Carriers or suppliers may require inspection. Failure to report damage, shortage, or delivery issues promptly may limit our ability to assist with a carrier or supplier claim, except where a remedy is required by law.
Returns & Refunds
Return Eligibility
To be eligible for return, products must generally be: returned within thirty (30) days of purchase (or delivery for shipped orders); new, unused, uninstalled, unaltered, unmodified, and undamaged; in original packaging with all labels, manuals, parts, accessories, and documentation; suitable for resale, as determined after inspection; and accompanied by proof of purchase.
Restocking Fee
A 10% restocking fee may be deducted from refunds for standard eligible returns. Additional charges may apply if products require repackaging, special handling, freight return, supplier return fees, or inspection.
Return Authorization
You must contact Mekco Supply before returning products. We may require a return authorization, return instructions, photos, or other information before accepting a return. Unauthorized returns may be refused or delayed.
Return Shipping
Unless the return is due to our error or an approved defective product claim, you are responsible for return shipping, freight, insurance, and safe packaging. Shipping and delivery fees are generally non-refundable unless required by law or unless the return is due to our error.
Refund Method
Refunds are issued after the returned product is received and inspected. Refunds are usually issued to the original payment method or, for approved commercial accounts, as an account credit. Processing times may vary depending on payment processor, bank, and account type.
Non-Returnable Items
Special & Custom Orders
Special-order, non-stock, supplier-direct, made-to-order, or custom products.
Cut-to-Length Products
Custom-cut pipe, tubing, hose, wire, or other cut-to-length products.
Clearance & Final Sale
Clearance, final-sale, discontinued, open-box, or liquidation items.
Used or Altered Products
Used, installed, altered, modified, repaired, rebuilt, reconditioned, damaged, or contaminated products, or products missing original packaging, labels, parts, accessories, or documentation.
Opened Sealed Items
Opened factory-sealed items where packaging integrity is important, including opened electrical, electronic, safety, testing, chemical, sanitary, or regulated products. Toilets, toilet seats, bidets, washlets, or similar sanitary products that have been opened, installed, or used are not returnable.
Damage from Misuse
Products damaged by improper storage, freezing, moisture, heat, misuse, abuse, incorrect installation, or failure to follow manufacturer instructions; products returned after the return period; and any product identified as non-returnable at the time of sale, quote, invoice, or product listing.
★ Symbol on Receipts and Invoices
A star (★) printed in front of a line item on any Mekco Supply receipt, invoice, POS sales slip, online order, or quote indicates that the item is non-refundable. Non-refundable means the sale is final — no returns, exchanges, refunds, or store credit will be issued for that item, regardless of the 30-day return window. The star is shown on both the printed receipt and on the live Point-of-Sale screen at time of purchase so customers can confirm with staff before paying.
Defective, Incorrect, or Missing Products
Reporting Defects
If you believe a product is defective, incorrect, or missing parts, please contact Mekco Supply promptly with order details, photos, and a description of the issue.
Remedies
For defective or incorrect products reported within thirty (30) days, we may, depending on the circumstances and manufacturer requirements, offer inspection, exchange, replacement, refund, account credit, or assistance with a manufacturer claim.
Inspection & Testing
Products alleged to be defective may be subject to inspection, testing, and manufacturer review. If a product is found not to be defective, or if the defect was caused by misuse, incorrect installation, improper storage, freezing, modification, unauthorized repair, abuse, or failure to follow instructions, the claim may be denied and additional shipping or handling charges may apply.
Missing Parts
Missing parts are often supplied directly by the manufacturer. We may assist with manufacturer contact information or coordination where practical.
Manufacturer Warranties
Coverage
Most products sold by Mekco Supply are covered, if at all, by the applicable manufacturer's warranty. Warranty terms vary by manufacturer and product.
No Additional Warranty
Mekco Supply does not manufacture the products sold on the website and does not provide any product warranty beyond the warranties expressly stated by Mekco Supply in writing or required by law. To the extent permitted by law, manufacturer warranties are the customer's primary warranty remedy.
Voided Warranty
Warranty coverage may be void or limited if the product has been improperly installed, installed by an unqualified person where professional installation is required, misused, modified, used outside specifications, exposed to unsuitable conditions, damaged during storage or transportation, used with incompatible parts, or installed contrary to codes, permits, or manufacturer instructions.
Warranty Claims
Approved warranty remedies may include repair, replacement, refund, or credit, depending on manufacturer terms and applicable law. Warranty claims may require proof of purchase, photos, product serial numbers, installation details, inspection, and return of the product.
Installation, Code Compliance & Professional Use
Safety & Code Risks
Plumbing, heating, hydronics, drainage, backflow, water treatment, electrical, pump, and related products can involve safety risks, building code requirements, permit requirements, pressure requirements, potable water requirements, and professional installation standards.
Customer Responsibility
You are responsible for confirming that each product is appropriate for your system, application, location, pressure rating, temperature rating, water condition, code requirement, project specification, and intended use.
Professional Installation
Where required, products must be installed by qualified, licensed, insured, or authorized professionals. Mekco Supply is not responsible for installation errors, product selection errors, code violations, failed inspections, damage caused by improper installation, or losses resulting from use of a product in an unsuitable application.
General Information Only
Any information provided by Mekco Supply staff, website content, product listings, or customer support is for general informational purposes only unless expressly stated in a signed written agreement.
Commercial Accounts, Contractors & Project Orders
Account Terms
Commercial, wholesale, contractor, reseller, trade, and project customers may be subject to additional account terms, including credit approval, project pricing, minimum quantities, purchase order requirements, delivery schedules, special-order restrictions, jobsite delivery conditions, credit limits, and collection terms.
Conflicting Customer Documents
If you provide a purchase order, request for quotation, supplier form, contractor form, project specification, or other document containing terms that differ from these Terms, those terms will not apply unless Mekco Supply expressly agrees to them in writing.
Continuing Supply Relationships
For commercial project orders, Mekco Supply may treat ongoing orders, deliveries, invoices, and related supply arrangements as part of a continuing commercial relationship to the extent permitted by applicable construction, lien, sale of goods, and credit laws.
Unpaid Products
Mekco Supply reserves all rights and remedies available under applicable law for unpaid products, including rights relating to unpaid invoices, construction projects, liens, trust obligations, security interests, collection remedies, and suspension of supply.
No Set-Off
For approved credit accounts, no deduction, holdback, back charge, or set-off may be taken unless approved by Mekco Supply in writing or required by law. Mekco Supply may suspend further shipments, deliveries, pickups, account access, or credit privileges until overdue amounts are paid.
Limitation of Liability
Excluded Damages
To the maximum extent permitted by law, Mekco Supply, its directors, officers, employees, agents, suppliers, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of profit, loss of revenue, loss of business, loss of data, project delay, business interruption, replacement labour, downtime, loss of goodwill, or third-party claims.
Maximum Liability
To the maximum extent permitted by law, Mekco Supply's total liability for any claim relating to a product, order, service, website use, delivery, return, warranty claim, or transaction will not exceed the amount paid to Mekco Supply for the specific product or order giving rise to the claim.
Excluded Causes
Mekco Supply is not responsible for losses caused by improper product selection, installation or use; failure to follow manufacturer instructions or comply with codes, permits, or inspections; unauthorized repairs or modifications; product misuse, abuse, neglect, freezing, or unsuitable operating conditions; supplier, manufacturer, or carrier delays; inaccurate customer information; failure to inspect products before installation; or third-party services, websites, payment processors, carriers, contractors, installers, or manufacturers.
Force Majeure
Mekco Supply will not be responsible for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, extreme weather, fires, floods, power outages, cyberattacks, pandemics, labour disruptions, transportation delays, carrier failures, supplier delays, manufacturer shortages, government actions, civil unrest, war, accidents, equipment failures, or other similar events.
